Terms of Service

Effective October 22, 2026. These terms are an agreement between you and DialectForge LLC, a Delaware limited liability company ("DialectForge", "we", "us"), for flowstatemcp.com, FlowState Relay (your address at fsmcp.com) and the accounts that run them (together, "the Service"). By creating an account or using the Service, you agree to them. If you don't agree, don't use the Service.

Open source and the Service

Two different things, under two different sets of rules.

• FlowStateThe FlowState software, including the relay agent that runs on your computer, is open source under the MIT license: github.com/dialectforge/FlowState. Your use of that code is governed by the MIT license, not by these terms. It stays free, and nothing here takes away a right the MIT license gives you.
• The ServiceThe website, accounts, the relay server and your fsmcp.com address are a service we run. These terms cover them. The relay server's code is not open source.
• NamesThe MIT license covers code, not names. "FlowState", "FlowStateMCP" and "DialectForge" and their logos are ours; don't use them in a way that suggests we endorse something we don't.

Early access

The Service is in early access (beta) and free. It is run by a small company. Places are limited, there may be a waitlist, and features, limits and prices may change or end. We will try to tell you before a change that matters to you.

Your account

• AgeYou must be at least 13. If you are under 18, or under the age of majority where you live, a parent or guardian must agree to these terms for you.
• Real emailSign in with an email address you control.
• Keep it safeYou are responsible for what happens under your account. Keep your sign-in methods secure and tell us at once if you think someone else has used your account.
• LimitsEach account can register one host device, the computer running FlowState. You can connect as many AI apps as you like to it through the relay, subject to the acceptable-use rules. Don't create extra accounts to get around a limit, the beta cap or the waitlist.

Acceptable use

Don't use the Service to:

• Break the lawDo anything illegal where you or we are, or help someone else do it.
• Harm peopleSpread malware, phish, harass, threaten, or share child sexual abuse material (absolutely prohibited, and reported).
• Misuse the relayUse your address for anything other than reaching FlowState, or another MCP server you run, on your own device. Don't use it to host a public website, share files with the public, or proxy other traffic.
• Break inAccess accounts, devices or data that aren't yours, or probe, scan or test the Service's security without our permission. Found a security problem? Report it to support@flowstatemcp.com.
• Overload itPut an unreasonable load on the Service, or get around its rate limits or other limits.
• Resell itSell, rent or share access to the Service without our written permission.
• InfringeViolate anyone's intellectual property or privacy.

The relay can't see what passes through it, so we act on what we can see (connection facts), on reports, and on what the law requires. We may suspend a device or account to stop a breach of these terms.

Your data and backups

• On your computerYour FlowState data lives on your own computer. You are responsible for keeping it, securing it and backing it up. We have no copy and can't recover it.
• It's yoursYou keep all rights in your content. The only permission you give us is to carry your encrypted traffic between your apps and your device.
• Your appsYou choose which AI apps connect to your FlowState and what they may do (read only, or read and write). We are not responsible for what those apps, or the AI models behind them, do with that access.
• Other servicesApps such as Claude, ChatGPT and Grok, and services such as GitHub and Let's Encrypt, are governed by their own terms.
• PrivacyHow we handle personal information is in our Privacy Policy.

Relay availability

There is no uptime guarantee during early access. The relay and the website may be slow, interrupted, or down for maintenance, with or without notice. Your device is reachable only while your computer is on, online and running the relay agent. Addresses are never reused: when a device is removed, its address stops working for good. Don't rely on the Service for anything where an outage would cause serious harm.

Paid plans and billing (placeholder)

Placeholder. There are no paid plans today, and nothing here is an offer.

This section will be written before any paid plan launches. It will cover prices, billing through Stripe, renewal, cancellation, refunds, taxes, how much notice we give before a price change, and what happens to your account if you stop paying. We won't charge you for anything without your clear agreement, and we will tell you before a free feature becomes paid.

Hosted tier (planned)

Not available yet. A planned Hosted tier would keep your FlowState data on our servers, with backups, encryption at rest, export and erase. It will come with its own terms and an updated Privacy Policy before it launches. Until then, these terms promise nothing about it.

Feedback

If you send us ideas or suggestions, we may use them freely, with no obligation to you.

Ending

• YouYou can stop at any time, and delete your account from your account page.
• UsWe may suspend or end your access if you break these terms, if your use puts the Service or other people at risk, if the law requires it, or if we stop offering the Service. We will give notice when we reasonably can. If we shut the Service down, we will try to give at least 30 days' notice.
• AfterYour relay address stops working, and your information is handled as the Privacy Policy says. FlowState on your computer keeps working, and your rights under the MIT license don't change. The sections on your data, disclaimers, limitation of liability, indemnity and governing law still apply.

Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DON'T PROMISE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, OR THAT IT WILL MEET YOUR NEEDS.

Some places don't allow these disclaimers. Where that is so, they apply only as far as the law allows.

Limitation of liability

TO THE FULLEST EXTENT THE LAW ALLOWS, DIALECTFORGE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, REVENUE OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE, EVEN IF WE WERE TOLD THEY WERE POSSIBLE. OUR TOTAL LIABILITY FOR ALL CLAIMS ABOUT THE SERVICE IS LIMITED TO THE GREATER OF WHAT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM, OR US$50.

Some places don't allow these limits. Where that is so, they apply only as far as the law allows.

Indemnity

If someone makes a claim against DialectForge because of your breach of these terms or your misuse of the Service, you agree to cover our reasonable costs of that claim, including legal fees, as far as the law allows.

Governing law

These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law rules. Disputes will be heard in the state or federal courts located in the State of Delaware, and you and we agree to their jurisdiction. If you are a consumer, this does not take away any protection the law of the place you live gives you.

Changes to these terms

We may change these terms. We will post the new version here with a new effective date, and tell account holders by email or on the website before a significant change takes effect. If you keep using the Service after that, the new terms apply. If you don't agree, stop using the Service and delete your account.

General

• Whole agreementThese terms and the Privacy Policy are the whole agreement between you and us about the Service.
• SeverabilityIf a part of these terms can't be enforced, the rest still applies.
• No waiverIf we don't enforce a part of these terms at once, we can still enforce it later.
• TransferYou can't transfer these terms to someone else. We may transfer them as part of a merger or sale of DialectForge.
